In these terms, "Merigrove", "we", "us", and "our" refer to Kacper Wiloch trading as Merigrove. "You" and "your" refer to the person using our website, services, or messaging programme.
By accessing our website, submitting a lead form, engaging our services, or opting in to receive text messages from us, you confirm that you accept these Terms and Conditions and that you agree to comply with them. If you do not agree, you must not use our website, services, or messaging programme.
Merigrove provides revenue operating system advisory and consulting services to founder led businesses, across four disciplines: sales and revenue, marketing and branding, finance and operational discipline, and management and leadership. The specific scope, deliverables, fees, and timelines of any engagement are set out in a separate agreement, statement of work, or proposal between you and us. These Terms and Conditions apply in addition to any such agreement. Where there is a conflict between these terms and a signed engagement agreement, the engagement agreement prevails for that engagement.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Our messaging programme is called Merigrove Client Messaging and is operated by Kacper Wiloch, trading as Merigrove. If you provide your mobile telephone number and tick the SMS consent box, you consent to receive text messages (SMS) from Merigrove for transactional and operational purposes only, namely:
We do not send marketing or promotional text messages under this programme.

You opt in by submitting your mobile telephone number and separately ticking the SMS consent box on a lead form embedded on a page of the merigrove.com domain. The consent box is not pre-ticked, and ticking it is not required in order to submit the form. Consent to receive text messages is not a condition of purchasing any goods or services. By opting in, you confirm that you are 18 years of age or older and that the mobile number you provide is your own, or that you are authorised to provide it and to consent on the account holder's behalf.
The consent wording you agree to reads as follows:
"I consent to receive transactional text messages from Kacper Wiloch trading as Merigrove at the phone number provided, covering appointment bookings, confirmations and reminders, security and verification codes, replies to enquiries I have made, and client onboarding. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out."
After you opt in, you will receive a single confirmation message in the following form:
"Merigrove: You are opted in to transactional messages about bookings and onboarding. Msg freq varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel."
Message frequency varies based on your interaction with us. Message and data rates may apply according to your mobile carrier and plan. You are responsible for any charges from your mobile carrier.
You may withdraw your consent and stop receiving text messages at any time by replying STOP to any message we send. We also accept the keywords UNSUBSCRIBE, END, QUIT, CANCEL, and STOPALL. You will receive one confirmation message, after which we will stop sending you text messages unless you opt in again.

Mobile carriers are not liable for delayed or undelivered messages. We do not guarantee that messages will be delivered, as delivery is subject to effective transmission by your mobile carrier and network conditions outside our control.
Our messaging programme is supported by major mobile carriers in the United States, including AT&T, Verizon Wireless, T-Mobile, US Cellular, and their affiliated regional carriers. Carrier support is subject to change and is outside our control.
How we collect, store, and use the personal data associated with this messaging programme, including your mobile number and consent record, is set out in our Privacy Policy.

Fees for our services are as set out in the applicable engagement agreement, proposal, or invoice. Payment terms are specified in those documents. Payments are processed by our third-party payment processor. We do not store your full payment card details.
Our advisory and consulting services are provided on a professional-advice basis, but we do not guarantee any specific business result, revenue outcome, or financial return, as these depend on many factors outside our control, including your own implementation and market conditions. Any guides, checklists, or other free resources we provide are general information only and are not accounting, tax, legal, or financial advice; you should take advice appropriate to your own circumstances before acting on them. Our website and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, Kacper Wiloch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our website, services, or messaging programme.
